Answer: I have successfully had condition 8503 waived from a visitor visa. Having condition 8503 waived then allowed for a valid application for an 820-801 visa application. In fact, this same client end up receiving a double grant. You need to strategically present an argument to the Department that addresses compassionate and compelling circumstances beyond the applicant’s control.
