NOICC – Replying to a request from the Department in relation to A Notice Of Intention to Consider Cancellation (general inclusive of 482 Visa specific issues)
No Further Stay Waiver (8503) – Submission Requests to Waive an 8503 No Further Stay Condition to allow a further on Onshore Application on the basic of “Compelling and Compassionate grounds”.
4020 Waiver and Arguing 4020 Doesn’t Apply - Submission Requests to Waive Condition 4020 to allow an application to be granted a visa (subject to 4020) despite the applicant having provided false or misleading information in a previous application (in the prescribed prior outline in PIC4020). Conversely, Submissions arguing that 4020 is being applied incorrectly and does not reflect the client’s circumstances.
s57 Natural Justice Submission – Submission addressing an invitation by the Department to comment and or to withdrawal a visa application before it is refused. This can cover a wide range of visa criteria.
AAT Visa Refusal or Cancellation Submission – Submissions addressing the criteria required for grant or approval of a visa or nomination. In some cases the submission is addressing a visa cancellation. Developing and providing substantive arguments to the AAT as to why a Delegate of the Minister has furnished an incorrect decision - referencing the relevant law and available case law.
